Letter from BIPOCANN Founder

Dear BIPOCANN Members & Network,

This past month, BIPOCANN took the opportunity to provide public comments on the Cannabis Administration and Opportunity Act discussion draft, which aims to end the decades of harm inflicted on communities of color by removing cannabis from the federal list of controlled substances, empowering states to implement their own cannabis laws, and expunging federal non-violent cannabis criminal records.

Please read our comments that were submitted to Majority Leader Schumer, Senator Booker, and Senator Wyden here. Highlights include:
  • Preserving state social equity programs;
  • Nurturing BIPOC cannabis industry entrepreneurs;
  • Allowing enough time to develop a federal regulatory/state framework; 
  • Suspending the Dormant Commerce Clause for a period prior to interstate commerce 
BIPOCANN applauds the U.S. Senate efforts to federally legalize cannabis and is thankful for the opportunity for public commenting on the discussion draft.

As the fall season approaches, we look forward to contributing to the ongoing national conversations regarding federal cannabis legalization, social equity, and increasing BIPOC entrepreneurship and business ownership in the cannabis industry.

Each month, we feature a member of the BIPOCANN network who is contributing outstanding work in ensuring the representation of BIPOC in cannabis.

For September, we are excited to recognize Michael Diaz-Rivera of Better Days Delivery in Denver & Aurora, Colorado. Michael shares his story of moving from selling cannabis to survive, to receiving a felony, to finding his passions for youth mentorship and education, before returning back to cannabis as a social equity applicant.


Michael Diaz-Rivera opened Better Days Delivery as a social equity applicant, with his license covering cannabis delivery for the Denver & Aurora areas in Colorado.

New Initiatives & Partnerships


BIPOCANN is preparing minority entrepreneurs and business owners to enter Virginia’s new cannabis economy. Virginia is the first state in the south to legalize adult-use cannabis, and a recent report from Marijuana Business Daily projects the new recreational marijuana market to generate up to $1.4 billion within five years.

BIPOCANN's Virginia initiative builds upon the company's national network model by introducing its first market-based membership for BIPOC entrepreneurs, business owners, and professionals. BIPOCANN Virginia will kick off with an introductory series of educational webinars, membership scholarships for social equity applicants, and a business directory of ancillary businesses and service providers who can support supplier diversity needs for the state's future cannabis licensees.

BIPOCANN Founder Selected to Judge the 2021 Clio Cannabis Awards

BIPOCANN founder, Ernest Toney, was recently selected as a juror for the 2021 Clio Cannabis Awards. Three juries, spanning Marketing & Advertising, Design & Innovation, and Film & Advocacy will determine the most creative, impactful cannabis brands, products, and campaigns of 2021. Ernest joins 15 industry peers to determine this year's winners in the Marketing & Advertising category.

Expanding on Clio’s enduring reputation for establishing best-in-class programs honoring creative ideas in a variety of specialized verticals, Clio Cannabis celebrates the creators at the forefront of cannabis marketing and communications. OUR BRAND name represents connecting BIPOC to the legal cannabis industry (BIPOC + Cannabis = BIPOCANN). We do this through strategies that: educate our demographics about the opportunities to participate in the legal cannabis industry; recruit new BIPOC entrepreneurs and business owners to the industry; and create valuable collaborations and business relationships within and amongst members of the BIPOCANN Business Network.
