Town Council makes a further challenge to planning decision.

Framlingham Town Council has started a second Judicial Review Process opposing East Suffolk Council’s decision to permit Leaper Land Promotions to build 35 houses on a green field off Victoria Mill Road in the Town. This is the second time the Town Council has challenged the District Council over this site. Almost exactly a year ago the Town Council began Judicial Review proceedings against the district after officers recommended approval for up to 49 houses on the site. These proceedings were called to a halt after the District opposed the planning application and did not grant it planning permission.
 
The developers submitted an identical application in the summer of 2022 with the only difference being a reduction in the number of houses from 49 to 35. East Suffolk Council planning committee voted (using the Chairman’s casting vote) to approve this application at its November meeting.
 
Within Framlingham there has been a very large number of residents who oppose the development. The plans call for the destruction of a green which is registered as an Asset of Community Value. Residents have also raised concerns about the narrow road and blind bends which have seen lorries getting stuck even before the development has begun.
 

Town Council Chair of Planning, Councillor Simon Garrett, said of the decision: ‘The Town Council listened to its residents the last time this development was proposed and it was glad that its legal efforts helped it being turned down. Despite the small reduction in the number of houses the Town Council has voted to oppose the second application as it is virtually identical to the first and the concerns raised by the residents remain. I find it difficult to understand how the District Council can refuse an application because of the loss of the Asset of Community Value then approve a very similar application with the same issue less than six months later. The Town Council hopes that this second legal challenge will also lead to the District changing its mind.
